Robert had exhausted every single remedy available to him to acquire a just stay of execution. Unless something changes, in less than a month, Texas will end Robert’s life despite overwhelming evidence he’s actually innocent.
Governor Abbott or the Court of Criminal Appeals can stop this tragedy before it happens. They can prevent Texas from executing an innocent man. The power to stop this injustice lies in their hands, but the pressure must come from ours.
A few months ago, I reached out to the co-author of this essay, Margaret Amshay, to see if she’d be interested in working on a piece about Robert Roberson’s fast-approaching execution date. She said yes within minutes.
Margaret is a 2025 graduate of Harvard Law School. She recently passed the bar in North Carolina. Later this fall, she’ll start her career as a public defender with the Mecklenburg County PD’s Office. In law school, she interned for Robert’s post-conviction counsel.

The strange thing about Robert’s case is that even the people who built it don’t believe it anymore. Brian Wharton, former chief detective in Palestine said flat out:
“I will forever be haunted by my participation in his prosecution. I am firmly convinced Robert is an innocent man.”
That alone should stop the machinery cold, right? In Texas, it barely registers. Finality is the state’s favorite word. But what’s finality worth if the underlying science was garbage? If the testimony was wrong? If he was saddled with appointed lawyers for years who disregarded his claim of innocence and did not investigate? If all of the new evidence finally unearthed is simply ignored? If an innocent man will die?

This is where the conservative legal movement stumbles.
Everyone sh/be terrified Texas is moving forward with Robert Roberson’s execution
Unless those in power have the courage, like former detective Brian Wharton, to admit grave mistakes were made, the doors stay shut. And in October 2025 that means death for a man who is likely innocent.
Unless something changes, Robert Roberson will be strapped to a gurney this October. They’ll push a needle into his arm, pump poison into his veins, and declare justice served. The press will write a paragraph or two. The state will close the books.
But the story will linger. A man is set to die because investigators rushed to judgment, doctors failed to conduct a full diagnosis and the courts have refused to reconsider overwhelming new evidence. That should terrify all of us. If it can happen to Roberson, it can happen to anyone.
As Bryan Stevenson would say, the real question isn’t whether Robert Roberson deserves to die for being an autistic father unable to explain his daughter’s complex medical condition and make his distress understood. The real question is whether we deserve to kill him.
We don’t.

Robert Roberson, an autistic man with an 8th grade education, whose two-year-old daughter died from medical malpractice, has spent twenty years on death row after being charged with murder, based on the discredited “shaken baby syndrome” theory. His daughter Nikki had been sick with pneumonia and was given inappropriate medications that are documented to cause breathing problems and death. Nikki died after being given those medications.

Expert testimony exposes widespread medical negligence within the pediatric health care system and Robert Roberson’s judge needs to hear it.
In this story, we say the medical consensus today is that the diagnosis of ‘Shaken Baby Syndrome’ (SBS) in criminal cases is based on “junk science.” There is growing skepticism of SBS and fierce debate within the medical community and in the courts, several of which have ruled the diagnosis is discredited and overturned SBS convictions. A New Jersey appeals court ruled that it’s based on “junk science.” But other courts and the American Academy of Pediatrics dispute that characterization and uphold the clinical and medical validity of SBS.

Thanks in part to a large public outcry, Travis County District Judge Jessica Mangrum granted a temporary restraining order, less than two hours before Roberson’s scheduled execution last year.
Roberson’s new execution date of October 16, 2025 gives us only weeks to raise our voices to save him.

Texas death row inmate Robert Roberson will not petition for clemency ahead of his scheduled execution in three weeks and will instead focus on obtaining a new trial in his capital murder conviction, his lawyer said Wednesday.

Art. 11.073. PROCEDURE RELATED TO CERTAIN SCIENTIFIC EVIDENCE. (a) This article applies to relevant scientific evidence that:
(1) was not available to be offered by a convicted person at the convicted person’s trial; or
(2) contradicts scientific evidence relied on by the state at trial.
(b) A court may grant a convicted person relief on an application for a writ of habeas corpus if:
(1) the convicted person files an application, in the manner provided by Article 11.07, 11.071, or 11.072, containing specific facts indicating that:
(A) relevant scientific evidence is currently available and was not available at the time of the convicted person’s trial because the evidence was not ascertainable through the exercise of reasonable diligence by the convicted person before the date of or during the convicted person’s trial; and
(B) the scientific evidence would be admissible under the Texas Rules of Evidence at a trial held on the date of the application; and
(2) the court makes the findings described by Subdivisions (1)(A) and (B) and also finds that, had the scientific evidence been presented at trial, on the preponderance of the evidence the person would not have been convicted.

Nothing could be stupider than treating killing with more killing. Despite that, this man is taking the brunt of a most insane charge, baby shaking syndrome when it is the authorities themselves who do this to our children. We need to stop paying taxes because as long as they're getting our money, what do they care what happens to us?
I know if I was an authority with guns and other weapons and I put this guy in the prison, I would be going to this facility and taking this man out of the custody of those stubborn morons. Imagine allowing the state to murder someone you KNOW FOR A FACT is innocent. WTF eh?
