Breaking: Federal Judge Hands Merck Win in Key Gardasil HPV Vaccine Case • Children's Health Defense
“U.S. District Judge Kenneth Bell concluded Merck did not have authority under federal law to add warnings to the vaccine’s label without prior approval from the U.S. Food and Drug Administration.”
“That federal law preempts the plaintiffs’ claims that Merck violated state laws when it failed to warn them of potential side effects, Bell said.
He also said there wasn’t enough evidence available when the plaintiff was injured to make the case that Gardasil caused the adverse events.”

Michael Baum, lead attorney for the plaintiffs, told The Defender: “We will be appealing the court’s order concluding that all of the Gardasil cases filed in federal court are preempted. In our view, none should have been.

Not that I 'like' per se, but thank you for sharing. I must comment, as I always read the bios of reporters. The reporter in the first piece you cite (from The Defender) holds a Ph.D from the University of North Carolina at Chapel Hill - interesting! Let's hope there are enough people with inside knowledge elsewhere (still on the inside) who can set the record straight. There are thousands of people in this industry, some of them most have enough character to speak out.
