Nova Scotia Court Of Appeals Rules On Attack On Free Assembly

The Nova Scotia Court of Appeal agreed that the Government’s exceptional road injunction went too far. It subjected every single person in Nova Scotia to unreasonable restrictions on fundamental rights in the absence of evidence that this was necessary or proportional.
This should be a strong signal to governments and courts across Canada that the Charter cannot be ignored when responding to urgent public policy issues.
The decision also reminds governments and lower courts that transparency and justification are required any time there is infringement of our fundamental freedoms.

Millions of $ in fines withdrawn and refunded: NSW
The NSW government cancelled more than 33,000 fines issued during the COVID lockdown following a Supreme Court ruling. 01:39 mins video
Justice Dina Yehia SC was set to hear arguments that two fines for between $1,000 and $3,000, did not meet the requirements of section 20 under the Fines Act.
Barrister Katherine Richardson SC said the plaintiffs had in effect been forced to take the "extraordinary step" of going to the Supreme Court after other unsuccessful attempts to have the fines reviewed. "It's only at the eleventh hour the Crown has finally accepted these were invalid," she said.
Within hours, the government moved to withdraw more than half the infringements issued under NSW's COVID-19 restrictions. The case centred on the technical basis that the notices did not provide a sufficiently detailed description of the offence committed and were therefore invalid.

Tribunal Canada reverses denial of EI benefit

OTTAWA: The Justice Centre is pleased to announce the Decision of the Social Security Tribunal of Canada reversing denial of EI benefits to Timothy Conlon, who lost his job for not getting the covid shots.
Mr. Conlon served as a delivery driver in the Toronto area, providing direct delivery of personal care items to homes. He would deliver sealed packages to peoples’ homes, buzz the doorbell and depart. He had little, if any interaction, with customers. Mr. Conlon was an exemplary employee with no complaints against him.
Despite this, his employer demanded he get the covid shots. Mr. Conlon expressed concerns about his existing high blood pressure and reports of some individuals getting blood clots after taking the shots. When Mr. Conlon said he wasn’t going to get the shots, his boss told him not to come back to work. Read more at

Judicial Notice
The largest civil disobedience in China in years, could ‘signal’ judges to proceed with caution in covid court cases and crimes against humanity vs. judicial notice.
In 2001, the Supreme Court of Canada reaffirmed ‘judicial notice’, where a judge usurps the right of god and declares fact without evidence or proof. Judges are influenced by public opinion and mainstream media so to a judge, ‘safe and effective’ is likely beyond reasonable dispute when it comes to covid restrictions.
